When do these terms and conditions apply

Before carrying out any work with us please read our terms and conditions thoroughly to avoid any future disputes and disappointments. By using our services you are agreeing to these terms. The terms and conditions are updated and the latest version always applies.

What do we mean by services

Any services offered by H&M, including all the trades we cover. (  (Plumbing, Heating, Renovation / Refurbishment, Electrics, Painting and Decorating, locksmith, Carpentry, Appliances, Roofing, Building, Emergencies, and Commercial):

  • Estimates

  • Project Work

  • Installations

  • Repairs

  • Emergency Call Outs

  • Servicing

  • Guarantees

Terminology

For the purpose of these terms and conditions these words refer to the following things:

  • “Us/We/Our” refers to H&M Locksmith and Building Services Limited.

  • “You” refers to you: the customer (the person or organisation for whom we agree to carry out work and/or supply or materials).

  • “Tradesperson/tradespeople” refers to the representative(s) appointed by H&M Locksmith and Building Services Limited to carry out work.

Hourly Rate Work

The total charge to you will consist of the cost(s) of:

  • Labour (the amount of time spent by the tradesperson carrying out work) including all reasonable time spent in obtaining non-stocked materials, charged in accordance with our current hourly rates.

  • Materials supplied by us (not exceeding the trade purchase price of materials +25% markup).

You will only be charged for the time spent related to your work. All other time, i.e. lunch breaks, is non-chargeable. All charges are subject to VAT at the prevailing rate, except in cases where the work carried out is zero rated.

Fixed Price Work

For the purpose of these terms and conditions these words have the following meanings:

  • “Us/We/Our” refers to H&M Locksmith and Building Services Limited.

  • “You” refers to you: the customer (the person or organisation for whom we agree to carry out work and/or supply or materials).

  • “Tradesperson/tradespeople” refers to the representative(s) appointed by H&M Locksmith and Building Services Limited to carry out work.

Offers & Incentives

Offers & Incentives are made at our discretion, these offers may only be used in conjunction at our discretion. There is no fixed percentage for each discount and can be as little as 1%. It is also not obligatory for us to give you any discount. Your eligibility for any discount also depends on the nature of the work needed.

Invoices & Payment

At our discretion, we may ask for a deposit of up to 70% which must be payable immediately if asked for.  Upon the completion of work, you will be invoiced. Payment must be paid in full within 30 days maximum or you could face repercussions.

When carrying out work with us you take sole liability to make payment in full unless you disclose when initially instructing us, to carry out work and/or supply materials that you are acting on behalf of a third party.

Timekeeping

When a day and/or time for work to be done is agreed upon, we shall make every effort to ensure that the tradesperson arrives on time. We assume no responsibility for the tradesperson's non-appearance or late arrival on site, or for the late or non-delivery of materials.

If the delay is due to a cause beyond our reasonable control, we shall not be accountable for the delay or the effects of the delay, and we will be entitled to a reasonable extension of time to complete such duties.

Cancelation

If you choose to cancel or rearange your booking, you must notify us before 7pm the day prior to the booking.

If you cancel your booking more closer prior to work being carried out, or materials being supplied, you will be liable for the cost of any time and materials incurred by us, together with the profit that would have been made by us, in accordance with the original instructions.

Satifaction

H&M is dedicated to offering professional, high-quality service to all of its clients. If you are not completely happy with our service(s) after we have completed the work, you must notify us in writing within 12 months. You must give us and our insurers the chance to assess and, if necessary, perform remedial work. If you do not tell us as mentioned above, we will not be responsible for any flaws in the service performed.

Guarantee

We provide a 12-month guarantee on labour carried out by an H&M Locksmith and Building Services LTD, in respect of faulty workmanship only. This is active from the date of completion of work, in addition to any manufacturer’s warranty/warranties.

The guarantee will become null & void if the work/appliance completed/supplied by us is:

  • Subject to misuse or negligence.

  • Repaired, modified or tampered with by anyone other than a Pimlico tradesperson. We will accept no liability for, or guarantee suitability, materials supplied by you & will accept no liability for any consequential damage or fault.

We will not guarantee any work in respect of:

  • Blockages in waste or drainage systems.

  • Any work undertaken on instruction from you and against the written or verbal advice of the tradesperson.

Only work conducted by us and for which full payment has been provided is work guaranteed. Any non-related defects resulting from advised work that has not been completed by us will not be covered by our warranty.

When we agree to perform work on installations of lesser quality (or that are more than 10 years old), we provide no warranty and take no responsibility for the work's efficacy or otherwise.

Liability

We will only be responsible for correcting our own guaranteed work, and we will not be accountable for any subsequent harm or claims stemming from additional work that was ignored or requested later and not completed at the time.

 

We shall not be held liable or responsible for any damage or defect caused by work that is not completely warranted or advised work that is not completed. Where you have been notified by the tradesperson verbally or by the office employee  work will not be guaranteed.

Any tradesperson whose negligence or bad performance makes us obliged to pay for those damages or rectification of work will be entitled to full reimbursement.

Any hazardous scenario arising from the Gas Safe Regulations or any Gas Warning Notice issued by a H&M tradesperson will be totally your responsibility. Our craftsmen work under their own Gas Safe Registration and are thus fully liable for any gas-related work and any resulting liabilities.

General

Except by an instrument in writing signed by a fully authorised representative and you, these terms and conditions may not be released, discharged, augmented, interpreted, amended, or modified in any way. Our terms and conditions will take precedence over any terms and conditions you use or that are contained, laid out, or referenced in any paperwork you send us. You agree to waive the application of any of these terms and conditions by entering into a contract with us.

 

These terms and conditions, as well as any contracts entered into between us and you, will be governed by and construed in accordance with English law, and will be subject to English law's exclusive jurisdiction.
